This document sets out the terms and conditions that apply when you book with Essence 144. Part A applies to all classes, development sessions, workshops and events. Part B applies specifically to retreats, in addition to Part A where relevant. Part C contains general provisions that apply to every booking. By booking with Essence 144, you confirm that you have read and agree to whichever parts apply to your booking.

 

PART A — Classes, Development Sessions, Workshops and Events

These terms apply to all Shamanic Kundalini Yoga classes, spiritual and intuitive development classes, workshops and events provided by Essence 144 (“we”, “us” or “our”), whether delivered in person or online. By making a booking, you confirm that you have read and agree to these terms.

1. Bookings and Payment

  • Places must be booked and paid for in advance unless otherwise agreed.
  • Your place is not confirmed until payment has been received.
  • It is your responsibility to ensure that the information supplied when booking is accurate and that you receive the correct booking details.
  • Unless otherwise stated, participants must be aged 18 or over.

2. Cancellations, Transfers and Missed Classes

  • If you cancel a booking, payments are normally non-refundable.
  • If you provide at least 48 hours’ notice, your booking may be transferred once to another suitable class, workshop or event taking place within three months, subject to availability.
  • Alternatively, you may transfer your place to another person, provided you inform us before the session and the new participant is suitable and able to participate safely.
  • Transfers are not available when less than 48 hours’ notice is given, except at our discretion in exceptional circumstances.
  • If you do not attend a booked session, whether in person or online, your payment and place will be forfeited.
  • Any cancellation rights provided by law remain unaffected.

3. Cancellations or Changes by Essence 144

Occasionally, we may need to cancel, postpone or make reasonable changes to a class, workshop or event due to illness, low attendance, venue difficulties or circumstances beyond our reasonable control.

If we cancel a session, you will be offered:

  • A transfer to another suitable date;
  • A credit for the amount paid; or
  • A full refund.

We will not be responsible for additional expenses you may incur, such as travel or accommodation costs, unless required by law. We recommend checking that a session is proceeding before making non-refundable travel or accommodation arrangements.

4. Health, Wellbeing and Participation

Our sessions may include physical movement, yoga postures, breathwork, meditation, relaxation, sound, visualisation and spiritual or energetic practices.

By participating, you confirm that:

  • You will take responsibility for your own physical, emotional and mental wellbeing;
  • You will work within your own abilities and limitations;
  • You will follow safety guidance given by the teacher;
  • You will stop immediately if you experience pain, dizziness, distress or feel unwell; and
  • You will seek appropriate medical advice before participating if you are unsure whether a practice is suitable for you.

Please inform the teacher before the session if you are pregnant, have recently undergone surgery, have an injury or medical condition, or have any physical or mental health concerns that may affect your participation. You are not required to disclose more information than is reasonably necessary to help us support your safe participation.

We may advise you not to undertake a particular practice or may suggest suitable modifications. Where we reasonably believe participation would be unsafe, we reserve the right to ask you to stop or withdraw from the session.

Our classes and practices are intended to support personal wellbeing and spiritual exploration. They are not a substitute for medical care, psychotherapy, counselling, diagnosis or treatment from an appropriately qualified healthcare professional.

You must not participate while under the influence of alcohol, recreational drugs or any substance that may impair your judgement or ability to practise safely.

5. Online Classes

For online sessions:

  • You are responsible for providing a suitable device, internet connection and safe space in which to participate.
  • You should ensure that you have sufficient room to move safely and that the area is free from hazards.
  • We cannot provide technical assistance during a live class.
  • Refunds or credits will not normally be provided where you are unable to participate because of problems with your own device, software or internet connection.
  • You are responsible for ensuring that your screen name and background do not reveal anything you wish to keep private.
  • You must not record, photograph or take screenshots of the session or other participants without prior permission.

If an online session is recorded, you will be informed before recording begins.

6. Behaviour and Conduct

We aim to provide a welcoming, respectful and inclusive space.

Participants are expected to:

  • Treat the teacher, other participants, venue staff and facilities with respect;
  • Respect the privacy, personal experiences and boundaries of other participants;
  • Avoid disruptive, threatening, discriminatory, aggressive or inappropriate behaviour; and
  • Follow reasonable instructions relating to safety and the smooth running of the session.

We reserve the right to refuse admission or ask a participant to leave if their behaviour is unsafe, disruptive or disrespectful. A refund will not normally be provided in these circumstances.

Participants may be responsible for the reasonable cost of repairing damage they deliberately or negligently cause to a venue, equipment or property.

7. Confidentiality and Group Sharing

Some classes and development sessions may involve personal discussion or the sharing of individual experiences.

Participants are asked to treat anything shared by another participant with sensitivity and confidentiality. You must not share another participant’s personal story, identity or private information outside the group without their permission.

While we encourage confidentiality, we cannot guarantee the actions of other participants.

8. Photography, Video and Promotional Material

We may occasionally wish to take photographs or short video clips during in-person classes, workshops or events for use on our website, social media, newsletters or other promotional materials.

We will let you know when photography or filming is planned and will request your permission. You are free to decline, and doing so will not affect your ability to participate.

Where possible, we will provide a clearly identified area for anyone who does not wish to be photographed or filmed. You may withdraw your consent for future use by contacting us, although it may not always be possible to remove material that has already been printed or shared by others.

Participants must not photograph, film or record another person without their permission.

9. Personal Belongings

Please take reasonable care of your personal belongings. We cannot accept responsibility for loss, theft or damage unless it results from our negligence or where responsibility cannot legally be excluded.

10. Intellectual Property

All original class content, written materials, meditations, recordings, exercises, course structures and resources provided by Essence 144 remain our intellectual property or that of the relevant teacher or creator.

Materials are supplied for your personal use only. They must not be copied, recorded, reproduced, taught, published, distributed, uploaded or shared with others without prior written permission.

Booking a session does not give permission to record any part of it.

11. Liability

Participation in physical, breathwork, meditation, spiritual and energetic practices carries an element of personal responsibility and, in some cases, inherent risk.

We will provide sessions with reasonable care and skill. To the fullest extent permitted by law, we will not be responsible for injury, loss or damage resulting from:

  • A participant failing to follow instructions or disclose relevant safety information;
  • Participation beyond a participant’s own abilities or limitations;
  • A participant’s pre-existing condition, except where responsibility rests with us under the law; or
  • Events outside our reasonable control.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Nothing in these Terms and Conditions affects your statutory consumer rights.

12. Personal Information

Personal information supplied when booking or participating will be handled in accordance with our Privacy Policy and applicable data protection law.

Health information will only be requested where reasonably necessary to support safe participation and will be treated sensitively.

 

 

PART B — Retreats

These terms apply specifically to Essence 144 retreats, residential events and associated activities, in addition to the general terms set out in Part A where relevant. By submitting a booking form or making any payment towards a retreat, you confirm that you have read, understood and agree to these terms.

13. Definitions

In this Part B:

  • “You” or “your” refers to the person making or attending the retreat booking.
  • “We”, “us” or “our” refers to Essence 144 and Vicky Coventry.
  • “Retreat” refers to any retreat, residential event or associated activity organised and delivered by Essence 144.

14. Booking and Payment

Your booking is not confirmed until:

  • We have received your completed booking information;
  • The required deposit or full payment has been received;
  • You have accepted these Terms and Conditions; and
  • We have sent you confirmation of your booking.

Payment may be made by bank transfer or by any other payment method offered at the time of booking.

Unless different payment arrangements are stated for a particular retreat:

  • A deposit is required when booking more than 12 weeks, or 84 days, before the retreat begins.
  • Full payment is required when booking 12 weeks or less before the retreat begins.
  • Any outstanding balance must be paid no later than 12 weeks, or 84 days, before the retreat start date.

The required deposit and payment schedule will be clearly stated before you book.

If we provisionally hold a place for you, payment must be received within 48 hours unless otherwise agreed. If payment is not received, we may release the place to another guest.

If the outstanding balance is not received by the stated deadline, we will contact you and allow a reasonable opportunity to make payment. If payment remains outstanding, we reserve the right to treat the booking as cancelled in accordance with our cancellation policy.

15. Deposits

All retreat deposits are non-refundable. Deposits contribute towards the advance costs and commitments involved in arranging the retreat and will be retained if you cancel your booking.

Nothing in these Terms and Conditions affects any cancellation or refund rights provided by law.

16. Travel Insurance

We strongly recommend taking out suitable travel insurance as soon as your booking is confirmed.

Your policy should, where appropriate, cover:

  • Cancellation because of illness or injury;
  • Bereavement or other unexpected personal circumstances;
  • Travel disruption or delay;
  • Loss or damage to personal belongings;
  • Medical treatment; and
  • Any activities you intend to undertake during the retreat.

For international retreats, suitable travel insurance will be a condition of attendance. You may be asked to provide evidence of insurance before travelling.

You are responsible for ensuring that your chosen policy provides adequate cover for your individual circumstances.

17. Cancellation by You

If you need to cancel your retreat booking, you must notify us in writing by email. The cancellation will take effect on the date we receive your written notice.

Your deposit will be retained.

If you cancel before the final balance payment deadline, any additional amount you have paid above the deposit will be refunded.

Once the final balance payment deadline has passed, payments are normally non-refundable because accommodation, catering, venue and activity costs will have been confirmed.

If we successfully fill your place after the final balance deadline, we may refund any payment made above the deposit after deducting any reasonable costs already incurred.

You may ask to transfer your place to another suitable person attending the same retreat, subject to our prior agreement and the conditions below.

If you do not attend, arrive late or choose to leave the retreat early, no refund or credit will normally be provided.

If you have suitable travel insurance, you should make a claim through your insurer. We will provide reasonable supporting documentation where required.

Nothing in this policy affects any cancellation or refund rights provided by law.

18. Transferring Your Place

Any transfer:

  • Must be requested in writing;
  • Is subject to our prior approval;
  • Must not affect room arrangements or increase the cost of delivering the retreat;
  • Requires the replacement guest to complete the necessary booking and health information; and
  • Requires the replacement guest to accept these Terms and Conditions.

We reserve the right to refuse a transfer where the proposed guest cannot safely or appropriately participate or where the transfer cannot reasonably be accommodated.

You and the replacement guest will be responsible for arranging payment between yourselves.

19. Cancellation or Significant Changes by Essence 144

We reserve the right to cancel or postpone a retreat where reasonably necessary, including because of illness, insufficient bookings, venue difficulties, safety concerns or circumstances beyond our reasonable control.

If we cancel a retreat for reasons within our reasonable control, you will be offered:

  • A full refund of the retreat payments made to us; or
  • The option to transfer the full amount paid to another Essence 144 retreat.

Any refund due will normally be processed within five working days.

We will not be responsible for separate costs you have incurred, including travel, accommodation or insurance expenses, unless required by law. We strongly recommend booking flexible or refundable travel arrangements wherever possible.

20. Events Beyond Our Reasonable Control

We will not be responsible for failing to provide a retreat as originally planned where this results from circumstances beyond our reasonable control.

These circumstances may include severe weather, fire, flooding, natural disaster, epidemic or pandemic restrictions, transport disruption, industrial action, government restrictions, civil unrest, terrorism, the closure or unavailability of a venue, or the serious illness or incapacity of an essential facilitator.

Where possible, we will offer:

  • Rescheduled retreat dates;
  • A suitable alternative retreat; or
  • A credit to be used within a reasonable period.

Your statutory rights remain unaffected.

21. Retreat Programme and Facilitators

The advertised retreat programme is provided as a guide.

We reserve the right to make reasonable changes to:

  • The timetable or order of activities;
  • Individual practices or sessions;
  • Facilitators, therapists or activity providers;
  • Meals or catering arrangements; and
  • Other practical details.

Changes may be made in response to weather, availability, the needs of the group or circumstances beyond our control.

We will make reasonable efforts to provide a retreat of an equivalent overall quality and character.

22. Accommodation and Room Allocation

Accommodation and room arrangements will be described before booking.

Where room preferences are requested, we will make reasonable efforts to accommodate them but cannot guarantee a particular room unless it has been expressly confirmed.

If you have paid a single-occupancy supplement, this must be included in your balance by the payment deadline.

Guests must treat the retreat venue, accommodation, furnishings and equipment with care. You may be responsible for the reasonable cost of repairing or replacing anything you deliberately or negligently damage or lose.

23. Travel and Arrival

Unless expressly included in the retreat description, you are responsible for arranging and paying for your own travel to and from the retreat.

Any assistance offered with lift-sharing or connecting guests who wish to travel together is provided as a courtesy. Travel arrangements remain the responsibility of the guests involved.

Please arrive within the stated arrival period. If you expect to be delayed, you should contact us as soon as reasonably possible.

24. Health, Wellbeing and Participation

Our retreats may include yoga, physical movement, breathwork, meditation, relaxation, sound, visualisation, time in nature, creative activities and spiritual or energetic practices.

By attending, you confirm that:

  • You will take responsibility for your physical, emotional and mental wellbeing;
  • You will participate within your own abilities and limitations;
  • You will follow reasonable safety instructions;
  • You will stop if you experience pain, dizziness, distress or feel unwell; and
  • You will seek appropriate professional advice if you are unsure whether the retreat or a particular activity is suitable for you.

You must provide relevant information about any health condition, pregnancy, injury, allergy, medication or support need that may affect your safe participation.

You are not required to disclose more information than is reasonably necessary to support your safety and wellbeing.

We may modify an activity or advise you not to participate where we reasonably believe it would be unsafe. In exceptional circumstances, we may ask a guest to withdraw from the retreat if we believe their continued participation presents a serious risk to themselves or others.

Essence 144 retreats are intended to support personal wellbeing and spiritual exploration. They are not a substitute for medical treatment, psychotherapy, counselling, diagnosis or care from an appropriately qualified healthcare professional.

25. Food Allergies and Dietary Requirements

You must inform us of any food allergies, intolerances or dietary requirements by the deadline given in your retreat information.

We will make reasonable efforts to accommodate notified dietary requirements. However, food may be prepared in a shared kitchen, and we cannot guarantee an environment completely free from allergens.

If you have a severe or potentially life-threatening allergy, please discuss this with us before booking so that we can establish whether your needs can safely be accommodated.

26. Behaviour and Conduct

We aim to create a safe, welcoming and respectful retreat environment.

Guests must:

  • Treat other guests, facilitators, venue staff and the local community with respect;
  • Respect other people’s privacy, personal experiences and boundaries;
  • Refrain from threatening, discriminatory, aggressive, disruptive or inappropriate behaviour;
  • Refrain from illegal activity;
  • Follow reasonable safety and venue instructions; and
  • Avoid attending activities while under the influence of alcohol, recreational drugs or any substance that may impair their judgement.

To support the safety and cohesion of the group, please let us know before leaving the retreat venue outside allocated free time.

If a guest seriously or repeatedly breaches these conditions, we reserve the right to ask them to leave. No refund will normally be provided, and the guest will be responsible for arranging and paying for their departure.

27. Confidentiality and Group Sharing

Retreats may involve personal reflection and the sharing of individual experiences.

Guests are asked to treat anything shared by another participant with sensitivity and confidentiality. You must not share another guest’s personal story, identity or private information without their permission.

Although we ask everyone to respect confidentiality, we cannot guarantee the actions of other guests.

28. Photography and Recording

We will let you know if photography or filming is planned and will request your permission. You are free to decline, and doing so will not affect your ability to participate.

Guests must not photograph, film or record another person without their permission.

29. Personal Belongings

31. Personal Information

Personal information supplied when booking or attending a retreat will be handled in accordance with our Privacy Policy and applicable data protection law.

Health and dietary information will only be requested and used where reasonably necessary to arrange the retreat and support safe participation.

 

 

PART C — General Provisions

The following provisions apply to all bookings made with Essence 144, whether for a class, workshop, development session, event or retreat.

32. Changes to These Terms

We may update these Terms and Conditions from time to time. The version applying to your booking will normally be the version published when your booking was made, unless a change is required by law or is necessary for safety reasons.

The latest version will be available on our website.

33. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the courts of England and Wales, without affecting any rights you may have as a consumer to bring proceedings elsewhere in the United Kingdom.
